Terms and Conditions

This website is operated by Crystal The Developer Inc. By using this site, subscribing to a service, or purchasing services, you agree to the terms outlined below.
1. Use of Site
You must be at least the age of majority in your region, or have parental or guardian consent.
You may not use the site for illegal or harmful activity or upload/transmit malicious code or software.
2. Products and Services
Crystal The Developer Inc. provides website design, development, website fixes, performance improvements, migrations, custom development, and ongoing website management services.
Service availability, scope, pricing, and timelines may change. I may refuse or cancel work that is fraudulent, abusive, unlawful, outside my expertise, or otherwise unsuitable.
One-time services and project work are subject to the agreed scope and payment terms.
3. Website Payment Plans
Clients who choose a 12-month payment option are entering into a payment arrangement for the full website project cost.
The required upfront payment must be paid before work begins. The remaining balance is billed automatically through Stripe in 12 monthly payments.
The website may be completed and launched before the payment plan ends, but the client remains responsible for completing all agreed payments.
If a monthly payment fails, the client will be notified and given 7 days to update their payment method or resolve the outstanding amount.
If payment is not resolved, Crystal The Developer Inc. may suspend hosting, support, updates, access to managed services, or additional project work until the account is brought current.
If the client cancels the payment arrangement or stops making payments before the 12-month term is complete, the remaining unpaid project balance may become immediately due.
Website payment plans are financing arrangements for the full project cost. They are not month-to-month subscriptions and cannot be cancelled without fulfilling the remaining financial commitment.
Ownership of custom code, project files, and final deliverables transfers to the client only after the project has been paid in full.
Until full payment has been received, Crystal The Developer Inc. retains ownership of all custom development work and may withhold source files, account transfers, or other deliverables.
The client remains responsible for all approved third-party expenses, subscriptions, platform fees, domain fees, software licences, and other project-related costs unless otherwise agreed in writing.
4. Website Guardian
Website Guardian is an ongoing website management subscription provided by Crystal The Developer Inc.
The service may include:
- Managed hosting
- SSL and security
- Cloudflare CDN and protection
- Automatic backups
- Performance monitoring
- Software and dependency updates
- Database management when required
- Google Analytics and Google Tag Manager support
- Email and contact-form support
- Reasonable text and image updates
- Bug fixes
- Priority technical support
Payload CMS may be included when needed. Not every website requires a CMS.
Website Guardian covers maintenance, support, and small ongoing improvements. Larger design changes, new pages, new features, custom integrations, ecommerce work, major CMS changes, branding, copywriting, and other project work are quoted separately.
Initial Commitment
By subscribing to Website Guardian, you agree to an initial 12-month service commitment.
The subscription is billed automatically monthly through Stripe for the duration of the initial 12-month term.
The subscription cannot be cancelled during the initial 12-month commitment without fulfilling the remaining financial commitment.
If you choose to cancel before the end of the initial 12-month term, the remaining monthly payments for the balance of the commitment become immediately due, unless otherwise agreed to in writing by Crystal The Developer Inc.
After the initial 12-month commitment has been completed, the subscription automatically continues on a month-to-month basis.
After the initial commitment, either party may cancel the subscription by providing 30 days' written notice.
No refunds will be issued for payments already processed or for partially used billing periods.
Pricing
Website Guardian pricing may be reviewed periodically. Existing subscribers will receive at least 30 days' written notice before any pricing change takes effect.
5. Setup and Migration
Website setup or migration may be included with Website Guardian at no separate upfront migration fee.
The cost of setup and migration is included as part of the 12-month Website Guardian commitment.
If Website Guardian is cancelled before the initial 12-month commitment is fulfilled, any remaining payments under the commitment remain payable.
Major redesigns, extensive content entry, custom integrations, ecommerce migrations, or complex development may require a separate quote.
6. Account and Billing
You agree to provide accurate and current billing and contact information and maintain the security of your account, if applicable.
Failed payments may result in suspended hosting, support, updates, or website access until the account is brought current.
7. Client Responsibilities
The client must provide accurate content, approvals, login access, domain access, third-party account access, and any other information reasonably required to perform the service.
The client is responsible for ensuring that submitted content, images, trademarks, and other materials are legally authorized for use.
Delays caused by missing content, approvals, or access may affect timelines.
8. Third-Party Services
Websites may use third-party services such as Stripe, Cloudflare, Google Analytics, Google Tag Manager, email providers, hosting providers, databases, CMS platforms, and other integrations.
Crystal The Developer Inc. is not responsible for third-party outages, policy changes, pricing changes, account suspensions, data loss, or service interruptions outside its reasonable control.
9. Ownership
The client retains ownership of their domain name, branding, website content, and business assets.
Custom website code and project deliverables are transferred according to the applicable project agreement and once all required payments have been completed.
Third-party software, open-source libraries, platforms, plugins, fonts, stock assets, and licensed tools remain subject to their own licences.
Upon cancellation of Website Guardian, reasonable assistance may be provided to transfer the website, files, or accounts. Additional migration or transfer work may be quoted separately.
10. Returns and Refunds
One-time digital services and completed development work are non-refundable once work has started.
Website Guardian payments are non-refundable once the billing cycle begins.
Approved refunds, if any, are provided only at the discretion of Crystal The Developer Inc. or where required by law.
11. Limitation of Liability
Services are provided with reasonable care, but uninterrupted availability, specific search rankings, revenue results, traffic levels, or business outcomes are not guaranteed.
Crystal The Developer Inc. is not liable for indirect losses, lost profits, third-party outages, unauthorized account access, client-provided content, or circumstances outside reasonable control.
12. Modifications
These terms may be updated periodically. Material changes will be posted on this page with a revised effective date.
Subscription pricing changes will be communicated in advance as described in the Website Guardian section.
